1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Final Global Movement and its affiliated ministries and entities worldwide (collectively, "Final Global Movement," "FGM," "we," "us," or "our"). By creating an account, accessing, or otherwise using The Emancipator application (the "App"), website at emancipatorgld.org (the "Website"), or any related services (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not create an account or use the Service. We encourage you to read these Terms carefully before using the Service.
2. About the Service
The Emancipator is a Christian daily devotional service that provides scripture readings, teachings, prayers, and related content authored by Dr. David Bindan and published by Final Global Movement. The Service is available as a mobile application (iOS and Android) and as a website.
The Service is provided free of charge as part of FGM's mission of maturing the body of Christ. While we strive to make the Service available at all times, we do not guarantee uninterrupted access.
3. Eligibility
To use the Service, you must meet the following requirements:
- You must be at least 13 years of age. If you are under 13, you may not create an account or use the Service.
- If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you must have the consent of a parent or legal guardian to use the Service.
- You must provide accurate and truthful information when creating your account and keep it up to date.
- You must not have been previously banned or removed from the Service for violating these Terms.
4. Account Registration and Security
When you create an account, you agree to the following:
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must provide accurate registration information and promptly update it if it changes.
- You may maintain only one account per person. Creating multiple accounts may result in termination of all accounts.
- You must notify us immediately if you become aware of any unauthorized use of your account or any other breach of security.
- We reserve the right to suspend or terminate accounts that violate these Terms, exhibit suspicious activity, or remain inactive for an extended period.
5. Intellectual Property
5.1 Content Ownership
All devotional content provided through the Service — including but not limited to daily topics, scripture selections, teachings, prayers, confessions, and associated media — is the intellectual property of Dr. David Bindan and Final Global Movement. The Emancipator publication bears ISSN 2467-9054.
The Emancipator name, logo, taglines, and visual branding are trademarks of Final Global Movement and may not be used without our prior written permission.
5.2 Your License to Use Content
We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the devotional content through the Service for your personal, non-commercial use.
5.3 Permitted Sharing
You may share individual devotional entries using the in-app share feature, which shares a text excerpt and a link to the Service. This sharing is for personal, non-commercial purposes only.
5.4 Prohibited Uses
- Reproducing, distributing, or publishing the content in any medium (print, digital, or otherwise) without our written permission.
- Selling, licensing, or commercially exploiting the content in any way.
- Modifying, adapting, or creating derivative works based on the content.
- Using automated tools, bots, or scrapers to extract, download, or copy content in bulk.
- Removing or altering any copyright notices, watermarks, or attribution from the content.
6. Copyright Infringement Notices
If you believe that content available through the Service infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our designated agent with the following information in writing:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with sufficient detail to allow us to locate it within the Service.
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Send DMCA notices to: info@emancipatorgld.org. We reserve the right to remove any content alleged to be infringing without prior notice and at our sole discretion.
7. User-Generated Content
Personal Notes. Notes you create within the Service are your property and are stored privately in your account. They are not visible to other users or to our team unless you choose to share them.
Feedback and Submissions. When you submit feedback, suggestions, bug reports, or other communications through the Service, you retain ownership of your content but grant Final Global Movement a non-exclusive, royalty-free, worldwide license to use, reproduce, and adapt such submissions for the purpose of improving the Service. We may remove any user-submitted content that violates these Terms or is otherwise objectionable.
Reactions. When you react to a devotional entry (e.g., "This Blessed Me"), that reaction contributes to an aggregate count visible to other users. Individual reactions are not publicly attributed to you.
8. Acceptable Use
You agree not to use the Service in any manner that:
- Violates any applicable law, regulation, or these Terms.
- Attempts to gain unauthorized access to any part of the Service, other users' accounts, or our systems and networks.
- Reverse engineers, decompiles, disassembles, or otherwise attempts to derive the source code of the App or any part of the Service.
- Uses automated systems (bots, crawlers, scrapers) to access, monitor, or copy content from the Service.
- Impersonates another person or entity, or falsely represents your affiliation with any person or entity.
- Harasses, threatens, or abuses other users or our team through feedback, messages, or any other communication channel.
- Uses the Service or its content for commercial purposes without our prior written permission.
- Interferes with or disrupts the Service, servers, or networks connected to the Service.
9. Push Notifications
If you enable push notifications, you may receive daily devotional reminders at your preferred time, as well as occasional announcements from the ministry. You can disable notifications at any time through the app Settings or your device's notification settings.
We may send important service announcements (such as changes to these Terms or critical security notices) regardless of your notification preferences. These announcements are infrequent and limited to essential communications.
10. Third-Party Services
The Service integrates with or links to third-party services, including Apple and Google for authentication, YouTube for video content, and finalglobalmovement.org for ministry information. Your use of these third-party services is governed by their respective terms of service and privacy policies.
We are not responsible for the content, privacy practices, or availability of any third-party services. The inclusion of a link to a third-party service does not imply our endorsement of that service.
The Service is operated from the United States. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with applicable local laws to the extent they apply.
11. Disclaimers
"As Is" and "As Available." The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
No Guarantee of Availability. We do not warrant that the Service will be uninterrupted, error-free, secure, or available at any particular time or location. We are not responsible for interruptions caused by factors outside our reasonable control, including internet outages, device failures, or force majeure events.
Content Accuracy. While we make every effort to ensure the accuracy of devotional content, scripture references, and related materials, we do not warrant that the content is free from errors.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Final Global Movement and its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to, use of, or inability to access or use the Service; (b) any conduct or content of any third party on or related to the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.
Because the Service is provided free of charge, our total aggregate liability to you for any claims arising out of or relating to the Service or these Terms shall not exceed the total amount you have paid us in the twelve (12) months preceding the claim, which is zero dollars ($0.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Final Global Movement and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third party's rights.
14. Termination
By You. You may terminate your use of the Service at any time by deleting your account through the app Settings. Account deletion is permanent and irreversible — all your data will be removed from our systems.
By Us. We reserve the right to suspend or terminate your account and access to the Service, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or the Service, or is otherwise objectionable.
Survival. The following sections survive termination of these Terms: Intellectual Property (Section 5), Copyright Infringement Notices (Section 6), Disclaimers (Section 11), Limitation of Liability (Section 12), Indemnification (Section 13), Governing Law (Section 16), and this Survival provision.
15. Changes to Terms
We may revise these Terms from time to time. If we make material changes, we will notify you through an in-app notification, email to your registered address, or a prominent notice on the Website prior to the changes taking effect.
The "Effective" date at the top of these Terms indicates when the most recent changes took effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
16. Governing Law and Disputes
These Terms and any disputes arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
In the event of a dispute, you agree to first attempt to resolve it informally by contacting us at the email address below. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through the state or federal courts located in the State of North Carolina, and you consent to personal jurisdiction in those courts.
Class Action Waiver. To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
17. Severability and Entire Agreement
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Final Global Movement regarding your use of the Service. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter hereof.
